Terms of Use
The terms that govern your purchases from kosmima-shop.gr.
Who we are
kosmima-shop.gr is the online shop of the sole trader ANASTASIA SIDIROPOULOU, with its registered address at 57 Ermou Street, second floor, 54623 Thessaloniki, Greece.
When the order becomes binding
The message you receive immediately after payment confirms that we have received your order and the amount paid. The order becomes binding when we send you the dispatch confirmation message, for the pieces named in it.
During that time we check every piece. If one is no longer available, or its price was obviously wrong, we will tell you at once and refund the whole amount, at no cost to you.
Prices and errors
Prices include VAT at 24%. Delivery costs are shown before you finally submit your order.
If, through an obvious typographical or technical error, a price is manifestly wrong, we are not bound by it.
We will notify you without delay, offer you the piece at the correct price, and if you do not want it on those terms we will refund the whole amount.
Delivery
We deliver pieces that are in stock usually within 1–3 working days of the order being confirmed, and in any event no later than thirty (30) days from the conclusion of the contract.
Pieces that need resizing, engraving or making to order are delivered later; we will tell you how long before you order, or immediately afterwards.
If we fail to deliver on time, you may give us a reasonable additional period. If that period passes without delivery, you are entitled to cancel and to receive the whole amount back. The risk of loss or damage passes to you when you, or a third party you have named, take possession of the piece.
The available delivery methods and their costs are described on the Delivery page, and form part of these terms.
Right to cancel — two separate periods
You have 14 calendar days from delivery in which to declare your cancellation, without giving any reason. Where an order contains several pieces delivered separately, the period runs from delivery of the last of them. Once you have declared it, you have a further 14 days in which to send the piece back. These are two separate periods.
How to declare a cancellation.
By telephone on 2310 536 169 or 6972 521 168, or by any other clear statement made to us. The telephone is the quickest, because we can tell you straight away where and how to send the piece.
Refunds.
We refund the price within 14 days of being informed of your cancellation. We may withhold the refund until we have received the piece back, or until you supply proof that you have sent it, whichever happens first.
What you bear.
Exceptions.
There is no right to cancel for engraved or personalised pieces, or for goods made to order or to your own specifications, nor for sealed goods which are not suitable for return for reasons of hygiene where the seal has been removed after delivery (earrings, for example).
The procedure — where to send the piece, how to pack it, which courier to use — is described on the Returns Policy page.
Legal guarantee and conformity rights
Every piece of jewellery and every watch is covered by the two-year legal guarantee of conformity provided for by the applicable law.
Where goods are not in conformity you have the rights the law provides — repair, replacement, a reduction in price or, where the law so provides, cancelling the contract.
The legal guarantee is separate from, and additional to, any commercial guarantee given by the manufacturer of a watch, which it in no way limits.
It does not cover damage that did not exist at delivery — ordinary wear, scratches, contact with chemicals or unsuitable storage.
Payment
The available payment methods, and the provider that handles card payments, are described on the Ways to Pay page and form part of these terms. A card payment is completed inside the provider’s secure environment, and your card details never pass through our own servers.
Intellectual property
The logo, the texts and in particular the photographs of the jewellery belong to us and are protected by Greek and European law. They may not be reproduced without written permission. The trade marks of the watches belong to their respective owners.
Liability
We make every effort to keep descriptions and availability accurate, without guaranteeing that the website will run uninterrupted. The photographs render each piece as faithfully as possible; small differences in colour are down to your screen.
Nothing in these terms limits or excludes our liability for wilful misconduct or gross negligence, or affects your mandatory rights as a consumer.
Complaints and dispute resolution
For any complaint, please contact us first at [email protected]. We reply within five (5) working days.
If no solution is found, you may apply to the Greek Consumer Ombudsman (synigoroskatanaloti.gr) or to the consumer line on 1520. Applying to those bodies does not affect your right to bring proceedings before the courts.
Changes to these terms
We may amend these terms. The version in force at the time you placed your order is the one that binds you; later changes do not apply retrospectively. Every change is posted here with a new update date.
Personal data
More information about how your personal data is processed can be found in our Privacy Policy.
Governing law and jurisdiction
Greek law and the law of the European Union apply.
As a consumer, you are not deprived of the protection of the mandatory provisions of the country in which you are habitually resident. You may bring proceedings against us either before the courts of Thessaloniki or before the courts of your place of residence. We may bring proceedings against you only before the courts of your place of residence.
If any term is held to be invalid, the remainder stay in force.
